Terms and Conditions

1. Scope of Application

These General Terms and Conditions apply to all orders placed via the online shop TheWoodysGallery, operated by:

Any deviating conditions of the customer shall not be recognized unless we expressly agree to their validity in writing.

2. Offer and Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.

By submitting an order, the customer makes a binding offer to purchase.
The contract is concluded as soon as we confirm the order by email or begin processing the order.

3. Prices and Small Business Regulation (§ 19 German VAT Act – UStG)

All prices stated in the online shop are final prices.

In accordance with § 19 of the German VAT Act (small business regulation), no VAT is charged and therefore it is not shown separately.

Any shipping costs will be indicated separately or agreed upon individually (e.g., for international orders).

4. Payment Terms

Payment is made via the payment methods offered in the shop, in particular:

  • PayPal

  • Klarna

  • Credit Card

  • Apple Pay

  • Google Pay

Payment processing is carried out via the payment services provided by Wix.
The purchase price is due immediately upon conclusion of the contract.

5. Delivery and Shipping

The production and shipping of the ordered products are carried out by our contracted printing company:

Delivery is made to the delivery address specified by the customer.

Delivery times depend on the product and are indicated in the shop or in the order confirmation.

Orders outside the EU are only processed after prior contact and individual agreement on shipping costs.

6. Retention of Title

The goods remain the property of the seller until full payment has been received.

7. Right of Withdrawal

Consumers have a statutory right of withdrawal.

Details can be found in the separate cancellation policy available in the shop.

Unless otherwise agreed, the customer bears the return shipping costs in the event of withdrawal.

8. Warranty and Transport Damage

The statutory warranty rights apply.

In the case of justified defects, we will of course bear the resulting shipping costs.

Transport damage must be reported immediately upon receipt of the goods so that a replacement delivery or compensation can be arranged.

9. Liability

We are fully liable in cases of intent and gross negligence.

In cases of slight negligence, we are only liable for the breach of essential contractual obligations and limited to the foreseeable, typical contractual damage.

Liability for damages resulting from injury to life, body, or health remains unaffected.

10. Copyright

All offered photographs and motifs are protected by copyright.

By purchasing a product, the customer does not acquire any rights of use to the depicted photographs.
Any further use, reproduction, or public display is not permitted without explicit written consent.

11. Custom-Made Products

If products are individually manufactured according to customer specifications, the right of withdrawal may be excluded pursuant to § 312g para. 2 no. 1 German Civil Code (BGB).

The customer will be informed separately during the ordering process.

12. Data Protection

Information on the processing of personal data can be found in the privacy policy available in the shop.

13. Applicable Law and Jurisdiction

The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

If the customer is a merchant within the meaning of the German Commercial Code, the place of jurisdiction is Hamburg.

14. Final Provisions

Should individual provisions of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
